What You Should Know about Auto Accidents and Insurance Companies
Insurance companies want you to think they have your best interests at heart, especially after an auto accident in Central Florida. The truth is often quite different. In reality, most insurance companies only care about one thing: paying injury victims as little as possible. That's why you need to be extremely careful when an adjuster for an insurance company contacts you soon after your accident. Everything you say could be used against you as justification for paying you less than you deserve for your accident.
That's just wrong, but we can make it right. At the Law Offices of Richard B. Troutman, we believe people should not be punished for being the victim of an accident caused by another driver. You should be fairly compensated for the true cost of your accident. Contact us immediately at 866-434-5770 for a free consultation.
We're not afraid to take on insurance companies for accident victims
If you are contacted by an insurance company adjuster after an accident, you might hear a friendly voice. But don't be fooled into thinking that the adjuster is on your side. While you might be tempted to get some quick cash from the insurance company, the truth is most of these offers don't even begin to come close to covering the true cost of a car accident. That's because most insurance companies don't take into consideration the long-term effects of an auto accident.
To level the playing field, contact a skilled Orlando accident claim lawyer. Richard Troutman knows how to deal with adjusters and maximize compensation for his clients. In fact, before becoming an advocate for injury victims, he used to practice insurance defense law. He understands how negotiations work on both sides.
We look at the big picture. We take into account lost income, future lost earnings, physical therapy and future medical procedures when demanding compensation for clients. If necessary, we can even file a personal injury lawsuit against an insurance company on your behalf if we believe that's the best way to resolve your case.
What is Florida's no fault insurance law?
Florida implemented a no-fault insurance law to reduce the number of lawsuits filed each year. The law requires motorists to carry $10,000 in personal injury protection coverage (PIP) and $10,000 in property damage liability.
With PIP insurance, drivers injured in car accidents do not have to hire a lawyer to retrieve money for medical expenses or disability. Instead, drivers injured in an auto accident in Florida are reimbursed by their own insurance company for medical bills, disability, or death expenses related to the accident, regardless of who was at fault. An individual may still file a lawsuit against a negligent driver.
While motorists are required to carry PIP and property damage liability to cover themselves and any property that is harmed in the event of an accident, they are not required to carry "bodily injury liability insurance" to cover the injuries of the other drivers involved. More than 50 percent of drivers are underinsured when it comes to covering the injuries of another driver involved in an accident. This is typically not a problem because most drivers have PIP insurance to cover their own injuries. It may be a problem, however, for motorcyclists and individuals visiting Florida, who are not required to have PIP coverage.
Motorcyclists involved in an accident with a driver carrying PIP coverage are automatically eligible to receive compensation for pain and suffering, whether or not they sustained a permanent injury. On the other hand, motorists must prove that their injuries are permanent. Motorcyclists, however, are not able to receive compensation for medical bills or disability unless the driver involved was carrying bodily injury insurance. For this reason, it is especially important for motorcyclists and those traveling through the state of Florida to carry what is called "uninsured motorist coverage."
